Preordered a CD that never shipped and they won't refund

I went to preorder a CD from this site because it looked like the official store. They took my money no problem. It's been almost a month after the release date and the thing never even shipped.

I've emailed them a bunch of times asking what's going on and all I get back is some form letter. So today I just bought the CD on Amazon instead. Then I went back to their site and demanded a refund. They told me since it was a preorder, they can't do anything unless the item is out of stock. But it never shipped. There's no reason they can't just give me my money back. This feels like a total scam.
