Free samples turned into a bill months later with no warning

A woman named Donna from US Industrial called our office and asked for accounts payable. She said she knew our previous bookkeeper and had worked with her before. She told me she could send free samples and a catalog at no charge. She asked if I wanted a free calculator or free markers. Since she mentioned the old bookkeeper, I said markers.

She never said one word about any price. She went out of her way to say it was free. Then the stuff showed up and about a month later they sent a bill for $113.62. We never ordered anything. Now they keep calling asking for payment and want to do a "POD" which I guess is proof of delivery.

Under 39 USC 3009 mailing unordered merchandise can be treated as a gift so we don't owe them anything. If you get a call from these people just ignore them. The whole company is a scam.
